Terms of Service

These Terms of Service (the “Terms”) govern your use of the hosting, domain, and website services provided by OnQ Hosting, a service of OnQ Development (“OnQ”, “we”, “us”). By opening an account, purchasing a plan, or using any of our services, you agree to these Terms. If you do not agree, please do not use the services.

1. Definitions

• Services means hosting plans, domain registrations, done-for-you website subscriptions, and any related support we provide.
• Hosting Plan means shared hosting, Ruby on Rails hosting, Node hosting, or managed VPS service.
• DFY Subscription means one of our done-for-you website plans (Essential, Growth, or Performance), under which we design, build, host, and maintain a website for a single monthly fee.
• Initial Term means the first twelve (12) months of a DFY Subscription.
• Your Content means text, images, logos, video, data, and other material you supply to us or publish through the Services.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that occurs under your account. Tell us promptly at info@onqhosting.com if you believe your account has been compromised.

3. Hosting plans

Hosting Plans are billed monthly in advance and renew automatically until cancelled. We do not raise your rate at renewal as a matter of course; if we ever change standard pricing, existing customers will be given at least thirty (30) days' notice before the change takes effect on their account.

You may cancel a Hosting Plan at any time, effective at the end of the current billing period. We do not pro-rate partial months except where required by law or where we have expressly agreed otherwise in writing.

Resource limits, including storage, bandwidth, and CPU, are described on the relevant plan page. If your usage materially exceeds the resources allocated to your plan, we will contact you to discuss an upgrade before taking any action that would affect your site.

4. 45-day money-back guarantee

Our 45-day money-back guarantee applies to Hosting Plans only. If you are not satisfied within 45 days of your first hosting payment, contact us and we will refund that payment.

The guarantee does not apply to:

• DFY Subscriptions, which are governed by Section 5 below;
• domain registration, renewal, or transfer fees, which are non-refundable once the registration is placed;
• third-party services, licences, or paid plugins purchased on your behalf;
• accounts terminated by us for violation of Section 7 (Acceptable use).

5. Done-for-you website subscriptions

5.1 What is included

Each DFY Subscription includes the design and build of a custom website, managed hosting for that website, and ongoing maintenance, for a single monthly fee. The Growth and Performance plans additionally include a stated amount of our working time each month, as described on the plan and in your order.

5.2 No upfront fee and Initial Term

DFY Subscriptions carry no upfront build fee. Because the cost of designing and building your website is recovered through the monthly fee rather than an initial payment, every DFY Subscription carries a twelve (12) month Initial Term, beginning on the date of your first payment.

After the Initial Term, the subscription continues month-to-month and you may cancel at any time with thirty (30) days' notice.

5.3 Included development time

Where a plan includes monthly working time (for example, one hour on Growth or two hours on Performance), that time is allocated per calendar month, does not roll over into later months, and is not redeemable for cash or credit. Unused time is forfeited at the end of each month.

Included time covers changes, improvements, and optimization work on the website we host for you. It does not cover work on systems we do not host, custom application development, third-party integrations requiring paid licences, or content production such as photography or copywriting, unless we agree to that work separately in writing.

5.4 What “SEO” means on the Performance plan

The Performance plan includes technical and on-page search engine optimization performed within the plan's included monthly hours. In practice this means work such as metadata and heading structure, internal linking, page speed and Core Web Vitals improvements, structured data, sitemap and indexing hygiene, and Search Console monitoring.

It does not include off-site work such as link building or digital PR, paid advertising management, ongoing content or blog writing, or third-party tool subscriptions. We make no guarantee of any particular search ranking, traffic volume, or conversion rate, as search engine results are outside our control.

5.5 Ownership and transfer

Your domain name and Your Content are always yours, at every stage, and we will release them to you on request at any time.

On completion of the Initial Term, the website we built for you may be transferred to you at no additional build cost, in a standard, portable format suitable for hosting elsewhere. If you wish to take the website before the Initial Term ends, you may do so on payment of the remaining balance of the Initial Term.

Custom code, designs, and assets we create specifically for your website transfer to you at that point. This does not include our internal tooling, or any third-party component that remains subject to its own licence.

5.6 Priority Development and additional work

Work that falls outside your plan's included monthly time, or that you need sooner than the normal queue allows, is available as additional development and is billed separately from your subscription.

• Standard additional development is quoted on request and runs in our normal queue, typically beginning within three to five business days.
• Priority Development is billed at $149 per hour. A priority request moves ahead of our normal queue and work begins within one business day of your approval, subject to availability. Priority pricing reflects when work starts; it is not a guarantee that work of any size will be completed within one business day.
• Emergency and after-hours work, meaning same-day, overnight, weekend, or holiday work, is available at $199 per hour where we are able to accommodate it. We will tell you in advance when a request falls into this category.

Additional development of any kind is billed with a one (1) hour minimum and in thirty (30) minute increments thereafter. We will confirm an estimate of the hours involved and obtain your approval before beginning any substantial piece of work.

Priority and additional development time is separate from, and never drawn against, the development time included in your plan. Included plan time always runs in the normal queue. Requesting that included time be expedited converts the request to Priority Development at the rate above.

5.7 Cancellation

You may cancel a DFY Subscription during the Initial Term at any time. Cancellation stops future monthly billing, but the remaining balance of the Initial Term becomes payable if you wish to retain the website. If you do not wish to retain the website, we will release your domain and Your Content to you and no further amount is due.

We may also cancel a DFY Subscription if you do not supply content, feedback, or approvals needed to complete the build, after we have made reasonable attempts over a period of at least sixty (60) days to obtain them.

6. Domains

Domain registrations are handled through our registrar partners and are subject to those registrars' policies and to ICANN requirements. Registration and renewal fees are non-refundable once placed. You are the registrant and owner of any domain we register on your behalf. Keeping your registrant contact details accurate is your responsibility, and inaccurate details can result in domain suspension under ICANN rules.

7. Acceptable use

You agree not to use the Services to store, publish, or transmit material that is unlawful, infringing, malicious, or deceptive. This includes malware, phishing pages, unsolicited bulk email, content that infringes another party's intellectual property, and any activity that compromises the security or stability of our infrastructure or another customer's service.

You are responsible for the security of applications you install and operate on your account, including keeping software and plugins updated where you manage them yourself.

8. Uptime

We target 99.9% network uptime, measured monthly and excluding scheduled maintenance, which we announce in advance where practical, and excluding outages caused by factors outside our reasonable control, including upstream provider failures and your own application code. If we fall materially short of this target in a given month, contact us and we will discuss an appropriate credit.

9. Support

We provide support 24 hours a day, every day, by email at info@onqhosting.com and through your client area. “Priority support” on the Growth and Performance plans means your requests are placed ahead of standard-queue requests; it is not a guaranteed response time unless we have agreed one with you in writing.

10. Backups and your data

We take regular backups of hosted accounts as an operational safeguard, and we will use them to help you recover where we reasonably can. Backups are provided on a best-effort basis and are not a substitute for keeping your own copies of anything you cannot afford to lose. We recommend maintaining independent backups of Your Content.

11. Suspension and termination

We may suspend or terminate the Services if payment is more than fifteen (15) days overdue, if you materially breach these Terms, or where continued operation poses a security or legal risk to us or to other customers. Except where an immediate response is necessary, we will contact you first and give you an opportunity to resolve the issue.

On termination, we will make Your Content available for retrieval for thirty (30) days, after which it may be deleted.

12. Fees and billing

All fees are stated in US dollars and are exclusive of any applicable taxes. Payments are processed through our billing system, and you authorise us to charge your selected payment method on a recurring basis until you cancel. Failed payments may result in suspension under Section 11.

13. Intellectual property

You retain all rights in Your Content. You grant us the limited licence needed to host, display, back up, and modify it for the purpose of providing the Services. We retain rights in our own branding, site, and internal tooling. Website deliverables created for you under a DFY Subscription transfer as described in Section 5.5.

14. Disclaimers

Except as expressly stated in these Terms, the Services are provided “as is” and without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

15. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Services in any twelve-month period is limited to the amount you paid us for the Services during that period. We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot lawfully be limited.

16. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will give notice by email or through your client area at least thirty (30) days before it takes effect. Continued use of the Services after that date constitutes acceptance of the updated Terms. The “last updated” date at the top of this page always reflects the current version.

17. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law rules. Any dispute arising under these Terms will be brought in the state or federal courts located in King County, Washington, and both parties consent to the jurisdiction of those courts.
